1. These terms

These terms are an agreement between you and Samuel Doggett, trading as Doggett Labs (“we”, “us”), for the Wings Near Me app on iOS and Android and its related services (the “app”). By creating an account or using the app, you agree to them and to our Privacy Policy. If you don’t agree, don’t use the app.

You must be at least 13 to use Wings Near Me. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. Your account

Give us accurate information and keep your sign-in details secure. You’re responsible for what happens on your account. One person, one account: don’t create accounts to get around a ban, inflate votes or post on someone else’s behalf. Usernames must follow the community rules below, and we may change or remove one that doesn’t.

3. Community rules

There is no tolerance for objectionable content or abusive behavior in Wings Near Me. When you post a review, photo, deal, username or report, you agree that it will not:

• harass, threaten, bully, demean or impersonate anyone;
• contain hate speech, or attack people for their race, ethnicity, religion, gender, sexual orientation, disability or any similar trait;
• contain sexual, violent or graphic material;
• include someone else’s personal information, or photos of people who haven’t agreed to it;
• be false or misleading, such as reviewing a place you haven’t eaten at, posting a fake deal, or reviewing a restaurant you own, work for or compete with;
• be spam, advertising or unrelated to chicken wings and the places that serve them;
• infringe anyone’s copyright, trademark or other rights, or break any law.

Don’t misuse the app itself either: no scraping, automated access, attempts to break or overload our systems, or reverse engineering the app except where the law allows it. Don’t flag or report content in bad faith.

Content is checked automatically, and you can report a review, deal or profile in the app. We review reports within 24 hours and may remove content, and suspend or close the accounts of people who break these rules, including people who abuse reporting. You can also block any user to hide their content from you.

4. Your content

You keep ownership of the reviews, photos and other content you post. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example, resizing a photo) and distribute that content to run and improve Wings Near Me, and to feature it in promoting the app. This license ends when you delete the content or your account, except for copies already shared in promotion or kept in backups for a limited time.

Only post content you have the right to share. You are responsible for it, and your public content can be seen by anyone who uses the app.

5. Restaurants, ratings and deals

Restaurant details, reviews and deals are added by users. We don’t verify them and can’t promise they’re accurate, complete or current. Check prices, hours and deal terms with the restaurant before relying on them. Reviews are the opinions of the people who wrote them, not ours.

Wings Near Me is not affiliated with, or endorsed by, the restaurants listed in it. Nothing in the app is allergen, nutrition or food safety advice: ask the restaurant if you have dietary needs or allergies.

6. Supporter subscription

On iPhone you can buy an optional Supporter subscription, which adds cosmetic perks such as a badge and extra avatars. It is sold through the App Store and renews automatically until you cancel it in your Apple account settings at least 24 hours before the period ends. Apple handles payment, billing and refunds under its own terms. Perks last until the end of the paid period. We may change the perks, the price (with notice through Apple) or stop offering the subscription. Deleting your account doesn’t cancel it.

7. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use Wings Near Me on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from. The app, its design, name, logo and artwork belong to us. We may update the app, change features or stop offering it.

8. Ending your use

You can stop using the app and delete your account at any time. We may suspend or close your account if you break these terms or if we need to for legal or safety reasons. Sections 4 (for content already shared), 5, 9, 10, 11 and 12 continue after your account ends.

9. Disclaimer

Wings Near Me is a free app made by an independent developer. To the fullest extent the law allows, it is provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don’t promise the app will be uninterrupted, error-free or that content in it is correct.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the app or content posted by others. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.

Some places don’t allow these limits, so they may not fully apply to you. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.

11. Indemnity

If someone brings a claim against us because of content you posted or your breach of these terms, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

12. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in Massachusetts. If you live in the EU or UK, you also keep the protection of the mandatory laws of your country, and you can bring a claim in your local courts.

13. If you got the app from the App Store

These terms are between you and us only, not Apple. Apple is not responsible for the app or its content. In addition:

• Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions.
• We, not Apple, are solely responsible for maintenance and support of the app. Apple has no obligation to provide any.
• If the app fails to meet any warranty that applies, you can notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app, to the extent the law allows.
• We, not Apple, are responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If anyone claims the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when using the app, such as your wireless data service agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

14. If you got the app from Google Play

These terms are between you and us only, not Google. Google Play’s Terms of Service also apply to your download and use of the app. If they conflict with these terms on how you obtained the app, Google’s terms apply to that part.

15. Changes to these terms

We may update these terms. We’ll change the date at the top and, for significant changes, tell you in the app before they take effect. If you keep using the app after that, you accept the new terms.

16. General

If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. You can’t transfer these terms to anyone else; we may transfer them if the app changes ownership. These terms and the Privacy Policy are the whole agreement about the app.
